F. Maury ⏚Je ne suis pas juriste, MAIS voilà quand même mes conseils sur les mandats de vente de biens immobiliers. C'est des trucs que je note dans chaque fucking mandat que je dois signer :* demandez systématiquement de changer les exigences de "courriers en recommandé avec accusé de réception", en "courriers simples ou électroniques". Voyez comme les agences, elles, elles sont OK avec le courrier électronique pour elles, mais elles exigent des LRAR pour vous ; c'est juste de la manipulation pour vous inciter à ne PAS envoyer ces courriers. Ça n'a rien à voir avec du juridique. C'est juste pour vous baiser.* insistez pour que les honoraires ne soient exigibles non pas "le jour où l'opération sera effectivement conclue et constatée dans un acte écrit, signé des deux parties, conformément à l'article 74 du décret N° 72-678 du 20 juillet 1972", mais après la réitération par un acte authentique. L'acte écrit, signé des deux parties, c'est le compromis (ou l'acte authentique si on ne passe pas par un compromis). Donc si vous acceptez ça, en théorie, le paiement est exigible dès le compromis. Le décret cité ne concerne que le cas des dénis ou des clauses suspensives. Mais si l'acquéreur "disparait" entre le compromis et l'acte authentique, c'est vous qui êtes potentiellement baisés : vous aurez rien vendu et vous devrez les honoraires ! La plupart des agences vous les demanderont pas parce que c'est pas bon pour le business, mais si l'agence est dans la mouise et s'apprêter à déposer le bilan, vous inquiétez pas qu'ils sauront vous tendre la main.* refusez de signer et faites des doigts à toutes les agences qui vous demandent de verser des honoraires partiels si vous vendez par vous-mêmes ou par une autre agence, tout en vous indiquant que c'est un "mandat simple". C'est ce qu'on appelle en réalité un "mandat préférentiel" et c'est 100% du temps une baise.Je le répète, je ne suis pas juriste ; mais je lis les petites lignes. Dans la pratique, toutes les agences honnêtes ont toujours accepté ces modifications quand je le leur ai demandées.C'était mes conseils à deux balles.
