Today, as the first <a href="https://kolektiva.social/tags/NativeAmerican" class="mention hashtag" rel="nofollow noopener noreferrer" target="_blank">#<span>NativeAmerican</span></a> to be the secretary of the interior — the first to lead any cabinet department — she has the opportunity to support the <a href="https://kolektiva.social/tags/FirstAmendment" class="mention hashtag" rel="nofollow noopener noreferrer" target="_blank">#<span>FirstAmendment</span></a> rights of the protesters she joined in the past.</p><p>"With her authority over energy development on federal lands, Haaland can be a voice for Indigenous and climate movements facing an urgent threat: the rapid spread of laws to protect 'critical infrastructure' that single out activists.</p><p>"Since 2016, 13 states have quietly enacted laws that increase criminal penalties for trespassing, damage, and interference with infrastructure sites such as oil refineries and pipelines. At least five more states have already introduced similar legislation this year. These laws draw from national security legislation enacted after 9/11 to protect physical infrastructure considered so 'vital' that the 'incapacity or destruction of such systems and assets would have a debilitating impact on security, national economic security, national public health or safety.'</p><p>"Many industry sectors are designated critical infrastructure, including food and agriculture, energy, water and wastewater, and communications, but most state critical infrastructure laws focus more narrowly on oil and gas <a href="https://kolektiva.social/tags/pipelines" class="mention hashtag" rel="nofollow noopener noreferrer" target="_blank">#<span>pipelines</span></a>. While protecting critical infrastructure is a legitimate government function, these laws clearly target environmental and Indigenous activists by significantly raising the penalties for participating in or even tangentially supporting pipeline trespassing and property damage, crimes that are already illegal. Many laws are modelled on draft legislation prepared by the American Legislative Exchange Council, also known as <a href="https://kolektiva.social/tags/ALEC" class="mention hashtag" rel="nofollow noopener noreferrer" target="_blank">#<span>ALEC</span></a>, a powerful lobbying group funded by <a href="https://kolektiva.social/tags/FossilFuel" class="mention hashtag" rel="nofollow noopener noreferrer" target="_blank">#<span>FossilFuel</span></a> companies like <a href="https://kolektiva.social/tags/ExxonMobil" class="mention hashtag" rel="nofollow noopener noreferrer" target="_blank">#<span>ExxonMobil</span></a> and <a href="https://kolektiva.social/tags/Shell" class="mention hashtag" rel="nofollow noopener noreferrer" target="_blank">#<span>Shell</span></a>.</p><p>"Central to the new critical infrastructure laws are increased criminal penalties and vague, broad definitions that could discourage protest and particularly, nonviolent civil disobedience. Many laws make any 'damage' to or 'interference' with a facility deemed critical infrastructure a felony. Under <a href="https://kolektiva.social/tags/Ohio" class="mention hashtag" rel="nofollow noopener noreferrer" target="_blank">#<span>Ohio</span></a>’s law, trespass with the purpose of 'tampering' with a facility is a third degree felony punishable by up to 10 years in prison and a $20,000 fine. In Indiana, a felony conviction is applied for any facility trespass, a crime that is typically a misdemeanor or fine.</p><p>"Vague language like 'damage,' 'tamper,' and 'impede' in critical infrastructure laws makes it unclear if, for example, knocking down <a href="https://kolektiva.social/tags/SafetyCones" class="mention hashtag" rel="nofollow noopener noreferrer" target="_blank">#<span>SafetyCones</span></a> and starting a fire next to a natural gas facility are the same under the law. Many critical infrastructure laws do not clarify if they apply only to land a company fully owns or also to pipeline easements, which run through both public and private lands. At least some laws apply to both. Only a week after Louisiana’s critical infrastructure law was enacted, opponents of the Bayou Bridge pipeline were charged with trespassing for boating on public waters on the border of a pipeline easement.</p><p>"The combination of overly broad language and steep penalties in critical infrastructure laws make it likely that future activists and supporting organizations will be discouraged from exercising their First Amendment-protected protest rights. A lawsuit brought in response to the <a href="https://kolektiva.social/tags/BayouBridge" class="mention hashtag" rel="nofollow noopener noreferrer" target="_blank">#<span>BayouBridge</span></a> charges will test the laws for the first time on First Amendment grounds.</p><p>"Many of these laws even extend beyond the protesters. In a proposed law in <a href="https://kolektiva.social/tags/Minnesota" class="mention hashtag" rel="nofollow noopener noreferrer" target="_blank">#<span>Minnesota</span></a>, anyone who 'recruits, trains, aids, advises, hires, counsels, or conspires' someone to trespass without a 'reasonable effort' to prevent the trespassing is guilty of a gross misdemeanor. In <a href="https://kolektiva.social/tags/Oklahoma" class="mention hashtag" rel="nofollow noopener noreferrer" target="_blank">#<span>Oklahoma</span></a> organizations that conspire with perpetrators are liable to be fined up to $1 million. These laws may infringe on the freedom of association protected under the First Amendment. Indeed, the Supreme Court ruled that the illegal actions of a few individuals do not implicate an entire group.</p><p>"The criminalization of environmental protest is fueled by federal security agencies and oil and gas companies, who are often major political donors. For years, the Department of <a href="https://kolektiva.social/tags/HomelandSecurity" class="mention hashtag" rel="nofollow noopener noreferrer" target="_blank">#<span>HomelandSecurity</span></a> and the Federal Bureau of Investigation have labelled activists at infrastructure sites as <a href="https://kolektiva.social/tags/DomesticTerrorists" class="mention hashtag" rel="nofollow noopener noreferrer" target="_blank">#<span>DomesticTerrorists</span></a> and violent extremists in order to justify further <a href="https://kolektiva.social/tags/surveillance" class="mention hashtag" rel="nofollow noopener noreferrer" target="_blank">#<span>surveillance</span></a> and <a href="https://kolektiva.social/tags/policing" class="mention hashtag" rel="nofollow noopener noreferrer" target="_blank">#<span>policing</span></a>. Government documents have been released that detail the FBI’s focus on '<a href="https://kolektiva.social/tags/AnimalRights" class="mention hashtag" rel="nofollow noopener noreferrer" target="_blank">#<span>AnimalRights</span></a> / <a href="https://kolektiva.social/tags/EnvironmentalExtremism" class="mention hashtag" rel="nofollow noopener noreferrer" target="_blank">#<span>EnvironmentalExtremism</span></a>,' describing even <a href="https://kolektiva.social/tags/NonviolentProtesters" class="mention hashtag" rel="nofollow noopener noreferrer" target="_blank">#<span>NonviolentProtesters</span></a> as <a href="https://kolektiva.social/tags/extremists" class="mention hashtag" rel="nofollow noopener noreferrer" target="_blank">#<span>extremists</span></a>.</p><p>"At Standing Rock, a private security firm [<a href="https://kolektiva.social/tags/Blackwater" class="mention hashtag" rel="nofollow noopener noreferrer" target="_blank">#<span>Blackwater</span></a>] hired by the pipeline companies consistently referred to protesters as 'terrorists' while working with law enforcement. Ahead of the <a href="https://kolektiva.social/tags/KeystoneXLPipeline" class="mention hashtag" rel="nofollow noopener noreferrer" target="_blank">#<span>KeystoneXLPipeline</span></a> protests in 2018, <a href="https://kolektiva.social/tags/DHS" class="mention hashtag" rel="nofollow noopener noreferrer" target="_blank">#<span>DHS</span></a> agents held an '<a href="https://kolektiva.social/tags/AntiTerrorism" class="mention hashtag" rel="nofollow noopener noreferrer" target="_blank">#<span>AntiTerrorism</span></a> training' for state and local authorities. In contrast, members of the <a href="https://kolektiva.social/tags/FarRight" class="mention hashtag" rel="nofollow noopener noreferrer" target="_blank">#<span>FarRight</span></a> militant group the <a href="https://kolektiva.social/tags/ThreePercenters" class="mention hashtag" rel="nofollow noopener noreferrer" target="_blank">#<span>ThreePercenters</span></a> have established a significant presence at oil and gas plants with little law enforcement reaction.</p><p>"To be sure, as the recent power outages in Texas showed so vividly, the United States needs reliable energy. But it’s questionable whether pipeline construction sites that could feasibly be moved or replaced with renewable energy sources should legitimately be considered 'vital' to the energy grid. Furthermore, a singular focus on this aspect of security comes at the cost of others. Whose essential resources do pipeline projects protect and whose do they threaten? Black Americans are disproportionately likely to live near natural <a href="https://kolektiva.social/tags/GasPipelines" class="mention hashtag" rel="nofollow noopener noreferrer" target="_blank">#<span>GasPipelines</span></a> and experience higher <a href="https://kolektiva.social/tags/CancerRisk" class="mention hashtag" rel="nofollow noopener noreferrer" target="_blank">#<span>CancerRisk</span></a> due to unclean air. An oil spill from the Dakota Access Pipeline could devastate the <a href="https://kolektiva.social/tags/SiouxTribe" class="mention hashtag" rel="nofollow noopener noreferrer" target="_blank">#<span>SiouxTribe</span></a>’s water source. Meanwhile, on some reservations, 10 percent of households lack electricity and as many as 40 percent of households must haul water and use outhouses. The well-being of these communities must count too.</p><p>"The rise in critical infrastructure laws may foreshadow more anti-protest legislation to come. A similar wave of anti-protest laws has already begun in response to the 2020 <a href="https://kolektiva.social/tags/BlackLivesMatter" class="mention hashtag" rel="nofollow noopener noreferrer" target="_blank">#<span>BlackLivesMatter</span></a> protests. State legislators contemplating critical infrastructure laws should bear in mind that laws that criminalize trespassing and protect the safety of construction workers and law enforcement already exist. Critical infrastructure laws don’t fill an unmet need — they only raise the penalties for specific groups of people. Courts adjudicating <a href="https://kolektiva.social/tags/FirstAmendment" class="mention hashtag" rel="nofollow noopener noreferrer" target="_blank">#<span>FirstAmendment</span></a> challenges in the coming years should recognize that these laws are overbroad and impose disproportionately severe penalties that chill freedom of assembly and association.</p><p>"As secretary of the interior, Haaland promises to uplift the voices of Indigenous and climate protesters in the Biden administration. Our aboriginally-occupied territories extend east to the James River and beyond. That is a historical truth. If Greenpeace can be held liable for telling the truth about Sioux Nation Treaty rights, then we are all in trouble.</p><p>"The construction of Fort Rice on our northern boundary in 1864 was a violation of the Fort Laramie Treaties. This required our Tribe to be vigilant. No one should be surprised that warrior society burials are found in this area, near the pipeline route.</p><p>"And do not insult our cultural experts, who have wisdom over matters most residents of Morton County or bureaucrats at the State Historical Society know absolutely nothing about. Energy Transfer and its lawyers should be ashamed of themselves. It was on the news and on the internet.</p><p>"Many of the protesters were Native American veterans of the United States armed forces. Energy Transfer used attack dogs against peaceful protesters and war heroes. But the jury sided with the out-of-state, unlicensed security with the attack dogs, instead of North Dakota veterans who supported Standing Rock.</p><p>"A Texas oil company has come to North Dakota, and its lawyers and propaganda machine are weaving stories about how the Standing Rock Sioux Tribe and our supporters have lied, and how the poor pipeline company, a trillion dollars richer than in 2016 when this all started, should receive extra millions from non-profit organizations. It’s a funny thing about liars – they always accuse everyone else of lying. The Greenpeace trial was marked by secrecy.</p><p>"The court is not making the transcript public. The documents obtained by Greenpeace about Energy Transfer’s terrible safety record are protected by a secrecy order and are not available to the public. The judge exhibited so much bias in favor of Energy Transfer that a team of international human rights lawyers felt compelled to monitor the trial. One prominent monitor stated 'In my six decades of legal practice, I have never witnessed a trial as unfair as the one against Greenpeace that just ended in the courts of North Dakota.'</p><p>"Standing Rock has tried to work for greater transparency on DAPL. It is our experience with the Army Corps of Engineers and Energy Transfer that all documents relating to DAPL pipeline safety are heavily redacted, and kept secret. What are they hiding? Who is looking out for the communities that may be affected by an oil spill? Peaceful demonstrations are a catalyst for the advancement of human rights. Yet around the world governments are criminalizing dissent and suppressing public <a href="https://kolektiva.social/tags/protest" class="mention hashtag" rel="nofollow noopener noreferrer" target="_blank">#<span>protest</span></a>, often as a means to protect <a href="https://kolektiva.social/tags/CorporateInterests" class="mention hashtag" rel="nofollow noopener noreferrer" target="_blank">#<span>CorporateInterests</span></a>. In this context, indigenous peoples increasingly find themselves as the subjects of arrests, criminal prosecution and police violence when defending the lands they rely upon for their existence and survival from <a href="https://kolektiva.social/tags/ResourceExtraction" class="mention hashtag" rel="nofollow noopener noreferrer" target="_blank">#<span>ResourceExtraction</span></a> by industries who are operating without the free prior and informed consent of the affected communities.</p><p>2. This report is submitted to the Inter-American Commission on Human Rights (<a href="https://kolektiva.social/tags/IACHR" class="mention hashtag" rel="nofollow noopener noreferrer" target="_blank">#<span>IACHR</span></a>) in conjunction with a thematic hearing held during the 172nd period of sessions. At the hearing,<br>Commissioners heard directly from those involved in the indigenous-led resistance to the <a href="https://kolektiva.social/tags/DakotaAccessPipeline" class="mention hashtag" rel="nofollow noopener noreferrer" target="_blank">#<span>DakotaAccessPipeline</span></a> (DAPL) at Standing Rock, North Dakota. This report addresses the criminalization and suppression of protest by indigenous human rights defenders and their allies by United States (U.S.) federal, state and local governments, working hand-in-hand with private security forces [<a href="https://kolektiva.social/tags/Blackwater" class="mention hashtag" rel="nofollow noopener noreferrer" target="_blank">#<span>Blackwater</span></a>], specifically in relation to the construction and operation of <a href="https://kolektiva.social/tags/DAPL" class="mention hashtag" rel="nofollow noopener noreferrer" target="_blank">#<span>DAPL</span></a> by <a href="https://kolektiva.social/tags/EnergyTransfer" class="mention hashtag" rel="nofollow noopener noreferrer" target="_blank">#<span>EnergyTransfer</span></a><br>Partners and Dakota Access, LLC (Dakota Access) and the connected <a href="https://kolektiva.social/tags/BayouBridgePipeline" class="mention hashtag" rel="nofollow noopener noreferrer" target="_blank">#<span>BayouBridgePipeline</span></a> (collectively the “<a href="https://kolektiva.social/tags/BakkenPipeline" class="mention hashtag" rel="nofollow noopener noreferrer" target="_blank">#<span>BakkenPipeline</span></a>”).</p><p>3. Standing Rock is an emblematic case of <a href="https://kolektiva.social/tags/IndigenousResistance" class="mention hashtag" rel="nofollow noopener noreferrer" target="_blank">#<span>IndigenousResistance</span></a> to extractive industry that drew attention from around the world as water protectors met on the banks of the <a href="https://kolektiva.social/tags/MissouriRiver" class="mention hashtag" rel="nofollow noopener noreferrer" target="_blank">#<span>MissouriRiver</span></a> in peaceful assembly in what was the largest gathering of indigenous peoples in the U.S. in 100 years. Standing Rock is merely one example of how the U.S. government works with industry to approve energy projects carried out without the meaningful participation or consent of<br>indigenous nations. Indigenous peoples are left with no choice but to peacefully protest and then are criminalized for their efforts to defend their lands and resources.</p><p>4. Since Standing Rock, there has been an alarming trend by the United States government and state legislatures to criminalize opposition to pipelines and other energy projects. These <a href="https://kolektiva.social/tags/AntiProtest" class="mention hashtag" rel="nofollow noopener noreferrer" target="_blank">#<span>AntiProtest</span></a> and so-called “<a href="https://kolektiva.social/tags/CriticalInfrastructure" class="mention hashtag" rel="nofollow noopener noreferrer" target="_blank">#<span>CriticalInfrastructure</span></a> laws” progress towards criminalizing dissent and implicitly condone the use of excessive force towards human rights defenders, often including indigenous peoples and their allies who are at the forefront of resistance to extractive industries. As the international community has acknowledged, these laws are incompatible with domestic and international law. The governments’ use of excessive force and mass arrests to threaten, intimidate, and silence “<a href="https://kolektiva.social/tags/WaterProtectors" class="mention hashtag" rel="nofollow noopener noreferrer" target="_blank">#<span>WaterProtectors</span></a>” seeking to defend their lands, resources, and <a href="https://kolektiva.social/tags/culture" class="mention hashtag" rel="nofollow noopener noreferrer" target="_blank">#<span>culture</span></a>, and the collusion with private security forces, violate fundamental human rights to <a href="https://kolektiva.social/tags/FreeSpeech" class="mention hashtag" rel="nofollow noopener noreferrer" target="_blank">#<span>FreeSpeech</span></a> and Aassembly enshrined in international human rights law and the <a href="https://kolektiva.social/tags/USConstitution" class="mention hashtag" rel="nofollow noopener noreferrer" target="_blank">#<span>USConstitution</span></a>.</p><p>5. The information provided here builds on a 2016 request for Precautionary Measures filed by the <a href="https://kolektiva.social/tags/StandingRock" class="mention hashtag" rel="nofollow noopener noreferrer" target="_blank">#<span>StandingRock</span></a>, <a href="https://kolektiva.social/tags/CheyenneRiver" class="mention hashtag" rel="nofollow noopener noreferrer" target="_blank">#<span>CheyenneRiver</span></a> and <a href="https://kolektiva.social/tags/YanktonSioux" class="mention hashtag" rel="nofollow noopener noreferrer" target="_blank">#<span>YanktonSioux</span></a> tribes, past Commission hearings on similar matters that remain unsettled, and reports on Indigenous Peoples and Extractive Activities, and the Criminalization of <a href="https://kolektiva.social/tags/HumanRightsDefenders" class="mention hashtag" rel="nofollow noopener noreferrer" target="_blank">#<span>HumanRightsDefenders</span></a>. In addition, the United Nations has reported on the situation at <a href="https://kolektiva.social/tags/StandingRock" class="mention hashtag" rel="nofollow noopener noreferrer" target="_blank">#<span>StandingRock</span></a> through the Expert Mechanism on the Rights of of indigenous peoples. The Standing Rock Sioux Tribe demands the immediate shut down of the pipeline. </p><p>"In a separate lawsuit in <a href="https://kolektiva.social/tags/NorthDakota" class="mention hashtag" rel="nofollow noopener noreferrer" target="_blank">#<span>NorthDakota</span></a> state court, <a href="https://kolektiva.social/tags/EnergyTransfer" class="mention hashtag" rel="nofollow noopener noreferrer" target="_blank">#<span>EnergyTransfer</span></a> is carrying out a fishing expedition, serving media and <a href="https://kolektiva.social/tags/WaterProtectors" class="mention hashtag" rel="nofollow noopener noreferrer" target="_blank">#<span>WaterProtectors</span></a> with third party subpoenas for the case slated in court for February 2025. </p><p>"In this case, the pipeline company is suing <a href="https://kolektiva.social/tags/Greenpeace" class="mention hashtag" rel="nofollow noopener noreferrer" target="_blank">#<span>Greenpeace</span></a> and <a href="https://kolektiva.social/tags/RedWarriorSociety" class="mention hashtag" rel="nofollow noopener noreferrer" target="_blank">#<span>RedWarriorSociety</span></a>, and two Red Warrior <a href="https://kolektiva.social/tags/WaterProtectors" class="mention hashtag" rel="nofollow noopener noreferrer" target="_blank">#<span>WaterProtectors</span></a>. DoomsdaysCW<p><a href="https://kolektiva.social/tags/StandingRockSioux" class="mention hashtag" rel="nofollow noopener noreferrer" target="_blank">#<span>StandingRockSioux</span></a> Tribe files new lawsuit over <a href="https://kolektiva.social/tags/DAPL" class="mention hashtag" rel="nofollow noopener noreferrer" target="_blank">#<span>DAPL</span></a> </p><p>By: Mary Steurer - October 15, 2024 </p><p>"The Standing Rock Sioux Tribe on Monday filed a new lawsuit against the U.S. Army Corps of Engineers arguing that the <a href="https://kolektiva.social/tags/DakotaAccessPipeline" class="mention hashtag" rel="nofollow noopener noreferrer" target="_blank">#<span>DakotaAccessPipeline</span></a> is operating illegally and must be shut down.</p><p>"The tribe has long opposed the pipeline, also referred to as DAPL, due to concerns that it violates the tribe’s <a href="https://kolektiva.social/tags/sovereignty" class="mention hashtag" rel="nofollow noopener noreferrer" target="_blank">#<span>sovereignty</span></a>, endangers <a href="https://kolektiva.social/tags/sacred" class="mention hashtag" rel="nofollow noopener noreferrer" target="_blank">#<span>sacred</span></a> cultural sites and threatens to pollute the tribe’s <a href="https://kolektiva.social/tags/WaterSupply" class="mention hashtag" rel="nofollow noopener noreferrer" target="_blank">#<span>WaterSupply</span></a>.</p><p>"The Army Corps of Engineers has jurisdiction over the section of the pipeline that passes under <a href="https://kolektiva.social/tags/LakeOahe" class="mention hashtag" rel="nofollow noopener noreferrer" target="_blank">#<span>LakeOahe</span></a> — a reservoir on the <a href="https://kolektiva.social/tags/MissouriRiver" class="mention hashtag" rel="nofollow noopener noreferrer" target="_blank">#<span>MissouriRiver</span></a> — roughly a half-mile upstream from the <a href="https://kolektiva.social/tags/StandingRockReservation" class="mention hashtag" rel="nofollow noopener noreferrer" target="_blank">#<span>StandingRockReservation</span></a>.</p><p>"The tribe in a 34-page complaint filed in U.S. District Court for the District of Columbia argues the Army Corps flouted federal regulations by allowing the pipeline to operate without an easement, sufficient study of possible <a href="https://kolektiva.social/tags/environmental" class="mention hashtag" rel="nofollow noopener noreferrer" target="_blank">#<span>environmental</span></a> impacts or the necessary emergency spill response plans, among other alleged violations.</p><p>"'We are fighting for our rights and the water that is life for Oceti Sakowin tribes,' Standing Rock Sioux Tribe Chairwoman <a href="https://kolektiva.social/tags/JanetAlkire" class="mention hashtag" rel="nofollow noopener noreferrer" target="_blank">#<span>JanetAlkire</span></a> said during a news conference the afternoon of <a href="https://kolektiva.social/tags/IndigenousPeoplesDay" class="mention hashtag" rel="nofollow noopener noreferrer" target="_blank">#<span>IndigenousPeoplesDay</span></a>.</p><p>"The Army Corps of Engineers did not immediately respond to a request for comment.</p><p>"The more than 1,000-mile-long pipeline carries crude oil from the <a href="https://kolektiva.social/tags/BakkenOilFields" class="mention hashtag" rel="nofollow noopener noreferrer" target="_blank">#<span>BakkenOilFields</span></a> of northwest North Dakota to Illinois, and has been operating since 2017. Its pathway includes <a href="https://kolektiva.social/tags/unceded" class="mention hashtag" rel="nofollow noopener noreferrer" target="_blank">#<span>unceded</span></a> land recognized as belonging to the <a href="https://kolektiva.social/tags/SiouxNation" class="mention hashtag" rel="nofollow noopener noreferrer" target="_blank">#<span>SiouxNation</span></a> under an <a href="https://kolektiva.social/tags/1851Treaty" class="mention hashtag" rel="nofollow noopener noreferrer" target="_blank">#<span>1851Treaty</span></a> with the U.S. government.</p><p>"The lawsuit was triggered in part by a 2024 engineering report that raised questions about the construction of the pipeline crossing below Lake Oahe, representatives of the tribe said Monday.</p><p>"The report calculated that up to 1.4 million gallons of bentonite clay-based drilling mud used in the horizontal directional drilling process was not fully accounted for in construction records. The report notes that there is no clear indication where the fluid migrated, but that it could have seeped into the surrounding soil.</p><p>“'The Corps has failed to act and failed to protect the tribe,' Alkire said of the report’s findings.</p><p>"The report was prepared by engineering consulting firm Exponent for environmental advocacy group <a href="https://kolektiva.social/tags/Greenpeace" class="mention hashtag" rel="nofollow noopener noreferrer" target="_blank">#<span>Greenpeace</span></a> as part of an ongoing lawsuit brought by pipeline developer <a href="https://kolektiva.social/tags/EnergyTransfer" class="mention hashtag" rel="nofollow noopener noreferrer" target="_blank">#<span>EnergyTransfer</span></a>. Greenpeace commissioned the report to defend itself against Energy Transfer’s allegations that Greenpeace defamed the pipeline during its involvement in protests against DAPL in 2016 and 2017.</p><p>[...]</p><p>"Standing Rock’s complaint also emphasizes that the Dakota Access Pipeline has still been allowed to operate despite that it no longer has an easement authorizing it to cross under Lake Oahe.</p><p>"The Army Corps approved the easement in 2017, but a federal judge later revoked it in 2020, finding that the Corps violated environmental law by granting it without properly researching the possible environmental impacts of the pipeline.</p><p>[...]</p><p>"The ban was related to a criminal pollution case against Energy Transfer for two pipelines in <a href="https://kolektiva.social/tags/Pennsylvania" class="mention hashtag" rel="nofollow noopener noreferrer" target="_blank">#<span>Pennsylvania</span></a>. Violations alleged in the criminal case included that Energy Transfer had used unapproved additives in the <a href="https://kolektiva.social/tags/DrillingFluid" class="mention hashtag" rel="nofollow noopener noreferrer" target="_blank">#<span>DrillingFluid</span></a> used to construct one of the pipelines. The company was convicted of <a href="https://kolektiva.social/tags/EnvironmentalCrimes" class="mention hashtag" rel="nofollow noopener noreferrer" target="_blank">#<span>EnvironmentalCrimes</span></a> under Pennsylvania law.</p><p>"For this reason, Standing Rock wonders whether the drilling fluid used to bore under Lake Oahe truly contained no toxins.</p><p>"'That’s a question the tribe has — what was in the drilling fluid?' Eyes were opened when mercs sicced vicious attack dogs on women and children guarding sacred burial grounds with their lives. Folks thousands of miles away watched in horror as they witnessed concussion grenades being thrown into crowds and elders being maced in the midst of sweat lodge raids. People will never forget live stream video picked up by mainstream media, showing hundreds of civilians being shot with water cannons in subzero temperatures by a corporate police state army. Some photos of injuries were judged too graphic to post by social media, as they revealed a young woman with a near severed limb and another who’d been blinded in one eye.</p><p>“This was not Iraq or Afghanistan. There was no foreign enemy invading our shores. These events occurred in the middle of the United States, on Lakota treaty lands; and the only thing these innocent people had done was dare to stand in the way of the Dakota Access Pipeline, the same one Bismarck, North Dakota residents rejected due to fears it would contaminate their water supply. This war zone created by Dakota Access and Morton County was meant to subdue Standing Rock residents and water protectors and force them to accept an unwarranted risk to their fresh water and the desecration of ancestral graves, under the barrel of a gun.</p><p>“Here in the states, hundreds of Native Nations and the American public sided with Standing Rock. Scores came to camp along the shores of the Mni Sosa (Missouri River). Others rallied in the local cities, signed petitions, and called the White House. Millions were outraged by the injustice.</p><p>“Yet who is paying for the corporate police state brutality I just mentioned? You are.</p><p>“Senator John Hoeven (R-ND), who accepted money from Energy Transfer Partners (the company behind the Dakota Access Pipeline) and has been vocal in his support of both the Dakota Access Pipeline as well as the Keystone XL pipeline, has announced that North Dakota will receive $15 million in federal funds to reimburse the state for costs incurred as a result of militarizing Barney Fife and company while they pushed the pipeline through for ETP and engaged in the violent, forced removal of water protectors. Hoeven slid said monies into the Department of Justice’s budget as part of Fiscal 2017 funding legislation.</p><p>“By the way, Hoeven sits on the Senate Appropriations Committee and is now the chairman of the Senate Committee on Indian Affairs. Welcome to Custer’s wet dream.</p><p>“The distinguished Senator from North Dakota would have us believe his state was alone in its mission to extinguish <a href="https://kolektiva.social/tags/NoDAPL" class="mention hashtag" rel="nofollow noopener noreferrer" target="_blank">#<span>NoDAPL</span></a>. Nothing could be further from the truth.</p><p>“When Morton County requested backup, law enforcement officials from across the nation came to North Dakota via the Emergency Management Assistance Compact (EMAC). The Sheriff’s Association also showed up in full force.</p><p>“New York Daily News writer Shaun King obtained audio where <a href="https://kolektiva.social/tags/EnergyTransferPartners" class="mention hashtag" rel="nofollow noopener noreferrer" target="_blank">#<span>EnergyTransferPartners</span></a> freely admitted that they worked closely with the Sheriff’s Association, and wow, did they ever. They became one and the same.</p><p>“<a href="https://kolektiva.social/tags/WaterProtectors" class="mention hashtag" rel="nofollow noopener noreferrer" target="_blank">#<span>WaterProtectors</span></a> who lived at camp can attest to <a href="https://kolektiva.social/tags/ETP" class="mention hashtag" rel="nofollow noopener noreferrer" target="_blank">#<span>ETP</span></a> and law enforcement’s collusion and fraternization, but the record speaks for itself.</p><p>“The Sheriffs’ Association has a $3.46 million budget, according to tax forms. Some of this funding comes from corporate sources, like TigerSwan. TigerSwan maintains offices in Iraq and Afghanistan. TigerSwan’s CEO is a former adviser to the multinational private security firm, Blackwater. Blackwater was founded by Erik Prince, a Trump campaign donor and the brother of Betsy DeVos, the US Secretary of Education. Besides funding the Sheriff’s Association, TigerSwan is in charge of Dakota Access intelligence and supervising overall security for the company. Tigerswan works for Dakota Access, while funding and partnering with the Sheriffs’ Association.</p><p>“The Sheriff’s Association purchased military gear from the US Department’s Defense Logistics Agency thanks to the Defense Department’s 1033 program. 'Thanksgiving Day is a reminder of the genocide of millions of Native people, the theft of Native lands, and the erasure of Native cultures,' states the official website for the United American Indians of New England. 'Participants in National Day of Mourning honour Indigenous <a href="https://kolektiva.social/tags/ancestors" class="mention hashtag" rel="nofollow noopener noreferrer" target="_blank">#<span>ancestors</span></a> and Native resilience. It is a day of <a href="https://kolektiva.social/tags/remembrance" class="mention hashtag" rel="nofollow noopener noreferrer" target="_blank">#<span>remembrance</span></a> and <a href="https://kolektiva.social/tags/spiritual" class="mention hashtag" rel="nofollow noopener noreferrer" target="_blank">#<span>spiritual</span></a> connection, as well as a <a href="https://kolektiva.social/tags/protest" class="mention hashtag" rel="nofollow noopener noreferrer" target="_blank">#<span>protest</span></a> against the <a href="https://kolektiva.social/tags/racism" class="mention hashtag" rel="nofollow noopener noreferrer" target="_blank">#<span>racism</span></a> and <a href="https://kolektiva.social/tags/oppression" class="mention hashtag" rel="nofollow noopener noreferrer" target="_blank">#<span>oppression</span></a> that Indigenous people continue to experience <a href="https://kolektiva.social/tags/worldwide" class="mention hashtag" rel="nofollow noopener noreferrer" target="_blank">#<span>worldwide</span></a>.'</p><p>"This year, the 54th annual National Day of Mourning takes place on 23 November - the same day as Thanksgiving. While not everyone can support the event in person, there are still many ways people can raise awareness toward issues affecting Indigenous communities from wherever they are - by '<a href="https://kolektiva.social/tags/decolonising" class="mention hashtag" rel="nofollow noopener noreferrer" target="_blank">#<span>decolonising</span></a>' their Thanksgiving dinner.</p><p>"<a href="https://kolektiva.social/tags/Decolonisation" class="mention hashtag" rel="nofollow noopener noreferrer" target="_blank">#<span>Decolonisation</span></a> can be defined as the active resistance against <a href="https://kolektiva.social/tags/settlerColonialism" class="mention hashtag" rel="nofollow noopener noreferrer" target="_blank">#<span>settlerColonialism</span></a> and a shifting of power towards Indigenous sovereignty. Of course, it’s difficult to define decolonisation without putting it into practice, writes Eve Tuck and K Wayne Yang in their essay, <a href="https://kolektiva.social/tags/Decolonization" class="mention hashtag" rel="nofollow noopener noreferrer" target="_blank">#<span>Decolonization</span></a> Is Not a Metaphor. Rather, one of the most radical and necessary moves toward decolonisation requires imagining and enacting a future for Indigenous peoples - a future based on terms of their own making.</p><p>"Matt Hooley is an assistant professor in the department of Native American and Indigenous Studies at Dartmouth College, where he teaches about US colonial powers and Indigenous cultural production. 'Decolonisation is a beautiful and difficult political horizon that should guide our actions everyday, including during holidays like Thanksgiving,' he tells The Independent. 'Of course, Thanksgiving is a particularly relevant holiday to think about decolonisation because the way many people celebrate it involves connecting ‘the family’ to a colonial myth in which colonialism is inaccurately imagined as a peaceful event in the past.'</p><p>"By decolonising our Thanksgiving, we can celebrate the holiday with new traditions that honour a future in which Indigenous people are celebrated. While the movement is nowhere near new, it received international attention in 2016 during protests against the <a href="https://kolektiva.social/tags/DakotaAccesSPipeline" class="mention hashtag" rel="nofollow noopener noreferrer" target="_blank">#<span>DakotaAccesSPipeline</span></a> - which continues to disrupt land and <a href="https://kolektiva.social/tags/water" class="mention hashtag" rel="nofollow noopener noreferrer" target="_blank">#<span>water</span></a> sources belonging to the <a href="https://kolektiva.social/tags/StandingRockSioux" class="mention hashtag" rel="nofollow noopener noreferrer" target="_blank">#<span>StandingRockSioux</span></a> Tribe.</p><p>"This year, sit down with family and friends to discuss an action plan and highlight the concrete steps you plan on taking to support Indigenous communities. 'Another, even simpler way would be to begin participating in what’s called a ‘Voluntary Land Tax,’ whereby non-Indigenous people contribute a recurring tax to the tribal communities whose land you occupy,' said Hooley.</p><p>"Food is perhaps the most important part of the Thanksgiving holiday, with turkey, stuffing, and mashed potatoes taking center stage. However, there are many ways we can make sure our dinner tables honour Indigenous futurisms too. Donald A Grinde, Jr is a professor emeritus in the department of Africana and American Studies at the University at Buffalo. 'Industrial agriculture is one of the most devastating contributors to the destruction of land and water everywhere, including on Indigenous land,' he said. 'Instead of buying food grown or made by colonial corporations, people could buy their food from Indigenous producers, or even simply make a greater effort to buy locally grown food or not to buy meat harvested from industrial farms.'</p><p>"Thanksgiving is just a day away. TigerSwan, which was staffed heavily with former members of military special operations units, branded its tactics as a 'counterinsurgency approach,' drawing directly from its leaders’ experiences fighting the so-called War on Terror abroad. </p><p>"TigerSwan did not just work in <a href="https://kolektiva.social/tags/NorthDakota" class="mention hashtag" rel="nofollow noopener noreferrer" target="_blank">#<span>NorthDakota</span></a>. Besides this recent work on the <a href="https://kolektiva.social/tags/StandingRockSioux" class="mention hashtag" rel="nofollow noopener noreferrer" target="_blank">#<span>StandingRockSioux</span></a> protests in <a href="https://kolektiva.social/tags/NorthDakota" class="mention hashtag" rel="nofollow noopener noreferrer" target="_blank">#<span>NorthDakota</span></a>, this company has offices in Iraq and Afghanistan and is run by a special forces Army veteran.</p><p>"According to a summary of the investigation, TigerSwan 'is in charge of Dakota Access intelligence and supervises the overall security.'</p><p>"The Morton County, North Dakota, Sheriff’s Department also recently concluded that another security company, Frost Kennels, operated in the state while unlicensed to do so and could face criminal charges. The firm’s attack dogs bit <a href="https://kolektiva.social/tags/protesters" class="mention hashtag" rel="nofollow noopener noreferrer" target="_blank">#<span>protesters</span></a> at a heated Labor Day weekend protest.</p><p>"Law enforcement and private security at the North Dakota pipeline protests have faced criticism for maintaining a militarized presence in the area. Since 2008, TigerSwan has won about $57.7 million worth of U.S. government contracts and subcontracts for security services.</p><p>"Company founder and CEO James Reese, a veteran of the elite Army Delta Force, served as the 'lead advisor for Special Operations to the Director of the CIA for planning, operations and integration for the invasion of Afghanistan and Operation Enduring Freedom' in Iraq, according to his company biography. Army Delta partakes in mostly covert and high-stakes missions and is part of the U.S. Joint Special Operations Command (JSOC), the latter well known for killing Osama Bin Laden. </p><p>"One of TigerSwan’s advisory board members, Charles Pittman, has direct ties to the <a href="https://kolektiva.social/tags/OilAndGasIndustry" class="mention hashtag" rel="nofollow noopener noreferrer" target="_blank">#<span>OilAndGasIndustry</span></a>. The tribe is concerned a pipeline oil spill could contaminate its water supply.</p><p>"The environmental review is key for whether the federal government reissues the permit.
