#Trump on Truth Social said Monday that #LosAngeles would be "completely obliterated" without his deployment of the #NationalGuard.

Over the weekend, the White House said that active duty #ArmedForces could be used to "augment & support the protection of Federal functions & property," the same missions the Guard is performing.

The admin has in total deployed 2,000 Guard personnel to the city.

Members of the #NationalGuard are rarely covered by the #PosseComitatusAct because they USUALLY report to their #state or territory’s #governor. That means they are free to participate in law enforcement if doing so is consistent w/ state #law. HOWEVER, when Guard personnel are called into #FEDERAL service, or “federalized,” they become part of the federal #ArmedForces, which means they ARE bound by the Posse Comitatus Act until they are returned to state control.

10 USC § 12406 - National Guard in Federal service

Title 10 of the United States Code outlines the authority of the President regarding the #ArmedForces, including powers related to mobilization, suspension of laws, & the use of #NationalGuard. The President has broad authority to order reserve components to active duty, suspend certain laws regarding promotions & separations, & call the National Guard into federal service during “emergencies”.

…So far, the #troops have been supporting law enforcement agencies, fanning out on foot patrols, in helicopters & in #combat vehicles to serve as a deterrent & to give the authorities far more eyes & ears on the ground.

For now, top #Trump aides have ruled out invoking the #InsurrectionAct, a >200-yr-old #law that would allow the use of the #ArmedForces for #LawEnforcement duty.

In the memo, #Hegseth said active duty #transgender #troops could identify themselves for "voluntary separation" from the #US #ArmedForces until June 6. Troops who are in the Reserves forces had until July 7.

"On conclusion of the self-identification eligibility window, the Military Departments will initiate involuntary separation processes," the memo said.
