House Republicans look to help Trump strip tax-exempt status of nonprofits he says support terrorism

By ALEXA ST. JOHN and MATTHEW DALY

WASHINGTON (AP) — "A proposal by Republicans in Congress would allow President Donald Trump’s administration to remove the tax-exempt status of nonprofits that it says support #terrorism, creating what some #nonprofits say is an arbitrary standard to financially punish #charities that advocate for issues that don’t align with his agenda.

"Unusual language added Monday to a reconciliation bill from the House Ways and Means Committee — the tax-writing committee — would allow for terminating the tax-exempt status of groups the administration deems 'terrorist supporting organizations.' The language mirrors a bill from the last Congress that passed in the House but did not pass the Senate.

"The definition and criteria for determining whether or how an organization supports terrorism are unclear. The bill also targets nonprofits in other ways, echoing complaints by Trump, who has called the tax-exempt status a 'privilege' that has been 'abused.' Trump has threatened to revoke tax-exempt status for groups that don’t abide by his directives or agree with his views."

"Michelle Roos, executive director of the Environmental Protection Network, which represents hundreds of former scientists and regulators, said last month 'we all pay the price' when charitable organizations are silenced based on politics.

"For example, the move to revoke #TaxExempt status could choke off funding for groups that urge greater action to promote clean air, water and land, work to help communities most affected by industrial pollution and advocate for projects and policies to combat #ClimateChange — among other issues.

" 'It threatens the rights, health, and future of every community,' Roos said in a statement.

Last month, Trump said he could target environmental groups and the ethics watchdog organization Citizens for Responsibility and Ethics in Washington."

#Harvard is among the vast majority of public & private #universities & #colleges that are #TaxExempt.

Under the #law, the #IRS initiates investigations based on established criteria & procedures, not based on presidential directives. The IRS is expected to operate independently & without political pressure.

If the IRS found that Harvard’s tax-exempt status should be revoked, Harvard would be given notice & an opportunity to contest the finding in court.

This is 100% not within his power & is totally #illegal.

#Trump on Friday said he planned to strip #Harvard University of its #TaxExempt status, the latest salvo against the Ivy League school amid a larger crackdown on elite #US #universities.

"We are going to be taking away Harvard’s Tax Exempt Status. It’s what they deserve!" Trump said in a post on his social media platform, without specifying when [or how] he might take action.

Harvard on Monday rejected numerous demands that it said would cede control to the govt. The Trump admin subsequently said it was freezing $2.3B in funding.

The #authority to investigate & change #TaxExempt statuses rests solely w/ #IRS, & the president is BARRED from directly or indirectly requesting that the agency exercise that #power against taxpayers [including #universities].

#TaxExempt status is available to charitable, religious & #educational orgs, as well as social welfare groups. But the organizations must strictly adhere to tax laws that prohibit them from engaging in certain political activity. There is NO proof that #Harvard violated any of those guardrails.

“The #IRS is supposed to administer the tax rules impartially, not pursue political #vendettas against exempt organizations,”said Steve Rosenthal, who served as snr fellow at the #TaxPolicy Center.

#Trump again escalated his admin’s fight w/ #Harvard by threatening its #TaxExempt status after the school defied his demands to change its policies in exchange for billions of federal #funding.

“Perhaps Harvard should lose its Tax Exempt Status & be Taxed as a Political Entity if it keeps pushing political, ideological, & terrorist inspired/supporting “Sickness?” Trump posted…. “Remember, Tax Exempt Status is totally contingent on acting in the PUBLIC INTEREST!”

Another offspring, #CenterForRenewingAmerica, targets what it calls a leftist “cultural revolution” + a “taxpayer-funded woke federal bureaucracy.”

Critics say that by incubating these & other grps, #CPI is running afoul of #laws prohibiting #TaxExempt #nonprofit orgs from engaging in partisan activity. #Watchdog org, Campaign for #Accountability, & a #progressive nonprof #research grp, Accountable.US, have filed a complaint…w/the #IRS, arguing #CPI’s …funds & svcs are for 1 #political party.
